Carly Simon Sues Starbucks Over Album Deal October 13, 2009

Carly Simon is suing Starbucks Corp., blaming the company’s now-defunct music venture for not doing enough to promote the album she released for them in 2008. In her suit, Simon claims that since the company did not promote the album, that it was doomed before it was even released. She is seeking unspecified damages related to the release of the This Kind of Love album.
In the suit, Simon says the album was not available in “a substansial number” of Starbucks stores during the key early months of its release. Also, Simon claims that when the disc was later stocked in Starbucks locations, that the price was slashed. Simon also claims in the suit that the album’s performance was affected by a decision days before the album’s release for Starbucks to end its involvement in Hear Music.
In a statement, Starbucks says the company met all its contractual obligations, and even extended the amount of time the album was promoted in New York and Boston.
To date, This Kind of Love has only sold 124,000 copies.

Carly Simon has signed with Starbucks’ Hear Music label, and will be releasing her next album, This Kind of Love on April 29. Carly collaborated with Jimmy Webb and Frank Filipetti for the album, which has a Brazilian-heavy sound. This Kind of Love is Carly Simon’s first album of original material since 2000’s The Bedroom Tapes.
