China’s Baidu.com Sued Over Music Copyrights February 29, 2008

Baidu.com, China’s top search engine, is being sued by the Music Copyright Society of China. The group claims that Baidu has allegedly violated music copyrights by “providing music listening, broadcasting and downloading services in various forms on its Web site without approval, and through unfettered piracy, earning huge advertising revenue on its huge number of hits.” The group then goes on to assert that Baidu’s piracy has forced legitimate online music providers to shut down.

The Music Copyright Society of China filed a lawsuit against Baidu in January, alleging the site illegally used 50 songs and demanding compensation. The lawsuit also demands that Baidu remove links to thousands of sites that provide unlicensed copies of music.

In response to the Prince Fans United coalition (which contains of three web sites that have been served “cease and desist” notices by Prince’s legal team), Prince has registered the domain name Princefamsunited.com. On the site, Prince has posted a seven-minute funk jam titled, “PFUnk.” The fanbase was made aware of the track’s existence through postings at fan site messageboards.

This new song makes no secret about who its target is. He refers to someone, apparently a member of PFU as “a big fat punk.” He also takes a jab at someone called “Weemolicious,” and also sings about wanting digital music to “disappear.”

Recently, John Giocobbi, the Managing Director of copyright agency Web Sheriff (which is helping Prince with all his copyright battles he has going on) admitted that they are going after more than just illegal bootlegging of Prince videos. He said that, “In essence, we’re going after everything, which is why it’s kind of pioneering.”

Now, I must say that I believe Prince has really started taking things too far. I was supportive when he was going after sites that could be seen as “bootlegging” him (such as unauthorized copies of Prince videos on YouTube, unauthorized merchanise with his likeness, etc.), but going after fan sites is just ridiculous. And releasing a “diss track” against the owners of these websites, in my opinion, is rather immature and juvenile. Honestly, when it comes to the courts, I can see them asking these fan sites to take down items that Prince would have rights to (such as album covers), but not to the fan-generated material (such as the photos of the tattoos inspired by Prince). Honestly, I think Prince would have a hard time proving that these fan sites are somehow “destroying” his image, and causing him financial harm. Let’s be honest, these fan sites are FREE PUBLICITY for the man. I honestly hope the legal system ends up ultimately siding with this coalition of fan sites.

Prince to sue YouTube, eBay, and Pirate Bay over unauthorized music use September 14, 2007

Prince is planning to sue YouTube, eBay, and Pirate Bay for the unauthorized use of his music on their respective sites.  Prince claims that YouTube can’t argue about not having control over which videos users post, pointing out that the site can filter out porn.  Meanwhile, YouTube’s response is that the service works with artists to help manage their music on the site.

Prince is also planning to sue eBay for allowing unauthorized items bearing his likeness to be posted for sale; he also plans to seek legal action against Pirate Bay, a site accused of being a source of pirated music and films.

I ultimately side with Prince on this issue.  He has every right to sue, since he owns the rights to his music, as well as has control over the use of his likeness.  Prince definitely has a case against the YouTube users who upload his music videos; in YouTube’s Terms of Service, it’s spelled out that you’re not supposed to upload videos that violate copyrights.  Now, when it comes to people uploading videos that happen to have a Prince song playing in the background (for example, someone videotaping a party, and a Prince song happens to comes on), he doesn’t have much of a leg to stand on.  And I also believe he has a good case going after the sellers on eBay selling unauthorized items bearing his likeness.  However, I hope I don’t hear about Prince trying to go after eBay users selling used copies of his music that they purchased legally, and are now selling off; in those instances, it’s like selling those items in a used store (except it’s being done over the internet rather than through a physical store).  I don’t know anything about Pirate Bay, so I really can’t comment on what kind of a case he would have against them.

While I support Prince and his efforts to protect his copyrights, I hope he uses caution and doesn’t go overboard with his lawsuits.
